The Biden administration will argue that an appeals court should allow a new rule that makes it much more difficult for anyone who crosses the border illegally to qualify for asylum if they pass through another country, like Mexico, to reach the United States.

A three-judge panel in Pasadena, California, has allowed the rule to stay in effect while it considers whether to overturn a judge’s ruling that found the policy illegal.
